the average moms and dads are not going to know how to mod them or how to aquire the games etc...
some people just do it for ease and some really are just that dumb..
i flash about 10-20 a month usually so its all good

they cant update ur drive firmware over live, thats just as illegal as flashing it ur self.
the can update the 360 however, but that still wont effect the drive.
the only way to get banned is to play an un stealthed game.
but with the new firmwares the 360 wont play un stealthed games anyway so its a win win situation
