speed cameras how many photos?

Post by crazylegs »

i have just been done by a mobile detection unit.i have asked for the photographic evidence and this has arrived today.the camera is a front on one so the second picture is the close one.the police have sent me one clear photo at a distance and a printed copy for the second picture.the first picture clearly shows the car and reg but the driver is not distinguishable.the second picture is very blurred shows only half a car ,no driver and the reg cannot be read.i thought both pictures had to be clear for there to be a prosecution.
any legal people out there with an answer? i dont want to contest this unless i have a good chance of it being dropped.i will try and post a picture of the evidence, but you may have to bear with me.

kev you mad bu88er, should know better at your age :D

i'm guessing the second pic doesn't matter to much as long as they can tell what time it was taken as the chances of another car the same colour, make and model as yours coming past a fraction of a second after you is unlikely :D

All you can do is "suck it and see"....

Tell them that the second picture isn't you. I don't think you will get away with it due to what Chris said above.

Never seen one of those pics before....

Just frame it and pay the boys - it's not going to push you into a totting up ban is it?

ooh unlucky Kev,

I don't think there is much you can do about it tbh.

Last time i got caught was three years ago. I bought a detector straight after that.

Just out of interest what was the speed limit?

thats the problem this will be the third one in a year! 20 years with nothing then they come all at once.(sorry about the car but i had to pick up some landrover bits.)if i can get away with this one then its a bit of breathing space. i cant imagine driving at 30 or 40 or even 70 but its getting closer now.

it was on the A1,i was done at 62 in a 50.they say it was a junction.it was 8.30 sunday morning not a car in sight,a nice gentle drive as far as i was concerned.i cant say if there was a junction or not, i never use the road this was a one off trip to pick some parts up.
does anyone know if the A603 junction at Sandy is the one with the mc donalds? cos i took the wrong exit coming out after a coffee so it may have been me cursing myself that did it.

If you dont give them the information of the driver at the time of the offence,
they will prosecute the registered keeper with:

Failing to provide information of the driver at the time of an alleged offence.

This from what I was told usually results in the same conviction.

Been there myself!!!

that pic is rubbish to see who was driving. looks like a storm trooper from star wars!

i think you can't go wrong with an appeal as your allowed to appeal aren't you i think?

it's weird as you could say you were driving but only coz they make you say who is driving which is stupid as i thought you couldn't incriminate yourself?

i say try it kev!

my 2 uncles and my dad got caught by camera's! it seems to be the generation that used to use coppers to catch speeders aint used to spotting the cameras or watching there speed so much.
my dad got caught doing 36mph in a 30 and got points and a £60 fine for it. he was coming to see me after i spun my Mk1

crazy legs kev, you bad lad!

i think kev, its a fixed penalty for 62 in a 40 and 3 points. But i see what you mean about the photo, have one of those 30 min free interviews with a solicitor, prehaps they can shed some light on the legal side, i would say contest it! those bugg3rs had £400 off me last summer and 5 points for one of those mobile "traffic saftey cameras"! Same thing, no one on the road on a sunny sunday morning, 87 in a so on the A4 in rural wiltshire, good i hate those vans, they take all the fun out of being a car owner!!!!  :x :x

I think its a fixed penalty if you are doin less than 20mph over the speed limit.

Over 20mph and its down to the magistrates to decide.

I was caught doin 54mph in a 30mph zone.

It was a dual carriageway and I didnt see the sign when I entered.
This was at 7.30AM on bank holiday May Day sunny morning.

No one was on the road apart from me and the C*&K lord with a camera in a van.

After not recieving anything in the post, I thought ok no problem.

(They are supposed to issue you with a notice of intended prosecution within 14 days of the alleged offence)

But then turns out they had sent the NIP to the previous keeper who in turn gave my details.
I was then sent a NIP which went to my Dads address, but by that time I had moved out and
sold the car. As I was not living at my Dads I didnt manage to pick up any post for quite some time.

Next thing I've got a court summons for "Failing to provide the information of a driver at the time of an alleged offence."

Anyway went to court, argued a bit, almost got 6 points and a fine but manged to get away with a fixed penalty, 3 points and £60 fine.

My advice is if you are offered a fixed penalty take it, the magistrates can double that if they are having a bad day.

So what if you said the driver was a foreigner you knew who borrowed it for a few days? Give them some address abroad and then they cant say you have failed to give the identity of the driver.

Probably cant get away with it but just interested to see if you could?

Pay up, 3 points and sixty quid. The photo only needs to identify your plate which it clearly does. Once you start to deny you were the driver then the police have the option of photo enhancement etc to identify you, they don't have to produce a clear picture of you to prosecute. Be careful of the foreign friend route etc. steps are being taken by some forces to pursue false claims and magistrates will cane you.

I went to to court, I pleaded guilty to "accelerating but not speeding" then made up silly amounts of money that I hade to pay out each month so I was left with about 28p at the end of it, in my stupid younger days I was followed but a green Clio (not realising it was a mate from school messing around) so I sped from the lights to see if it followed, it did for a while but then backed off and turned so I slowed down, then flashing blue lights, OOpppps he made me get out and he asked me to look at a digital read out on a Viscar 5000 police pilot system. I said it was the date? (it was my speed) 79.88Mph in a 30! I got 5 points (later came back with 3?) and I got a £100 fine, I was very lucky, the copper could not believe it! I got pulled over contently by him every week without fail!. not any more don't fancy getting done for speeding ever again!

i got pulled on valentines day back in err 2003 i think it was, got caught doing over 100mph down the A130. i thought the black car behind me was the one that cut me up on the roundabout that i hooted and gave the finger :)

after the roundabout this black car came up fast behind me so i nailed it through the lights and down the A130.

i moved over after a while and thought 'sod it if the guy has road rage i'll let him pass and get it over with' but when i pulled back in the car came in straight behind me which is weird if your after someone i thought.

i then got VERY suspecious as the car seemed to follow my every move so started to slow and then he pulled me :D

that was back in my crappy cavalier! glad i didn't have the turbo as the copper was in an un-marked mondeo diesel! i'd of lost him with ease! haha

been pulled twice in my MK1 MR2, one near last xmas for a breath test and before that after flying round a roundabout, well i think it was as the copper got another call before he could tell me why :D

hoping my luck with the law stays that way!

oh dear oh dear!

bend over and lube up!!

or pretend the car was being test driven by a potential buyer??
even if they did go down the enhanced photo route ... i beleive enhanced photo's are not permitted as court evidence .. could be wrong!

.. I was once late for a wedding evening do .. pushed my company vectra to the limit and passed a stationary copper without realising ... was doing about 130mph ... when i noticed the flashing blue lights in the distance ... swerved across three lanes and came off the gas ... was clocked at 107 on a clear motorway.

As it panned out .. they sent me a incorrect statement of facts ... the offense happened at 22:30 at night on the 24th ... the statement of facts said that it happened at 2:30am on the 24th .... that would have put me over 400 miles away tucked up in bed. I did however plead guilty in the court (i'm too honest) and explained the mixup to the judge ... cos i was honest they were nice to me ... should have had a 6 month ban ... they gave me 2 weeks and a £130 fine !

my advice to you ... scrutinise the statement of facts :) !!

I suppose in reality .. I could have got away clean ?
