I don't get it...

He was behind and then stopped to help? Surely if he was 'racing' then they would have both been pretty close and he would have been at around the same point in the road - or he would have been further on down the road?

thats harsh, but surely there is something he is not telling us.
I wonder what the prosecutor offered as evidence to prove they where racing? should have stuck with not guilty if he indeed was.

Possibly a statement from the survivor??Who knows.

Sorry for the bloke really. And it's very good what they are trying to do for him. However the diffence in power proves little. How many times have we blitz'd past a less powered motor/chav charriot just to show them whats what?? Doesn't mean they were racing etc. But he might have decided to have a pop at it. Then again if he did he would've been in front not behind. Didn't his brief point this out??? Any decent one would have.

They also mention cctv footage...of what??

We'll never get the full story so we can only guess as to what happend. I can not beleive that they were racing.

Maybe... the blokes in the fiesta thought they were racing??? RWD, wet weather Nissan going slow/on a par with the fiesta?? etc etc

If it did happen as the post on SXOC says then it sounds like the courts have tried to make an example of the Nissan driver, it just shows that doing the right thing is wrong these days, especially considering the bloke stopped to help and obviously wasn't malicious or anything.

The lesson here seems to be never help anyone, ever.

A race is a race, it doesnt matter what the cars involved were. A fiat uni can race a ferrari 360, even though it doesnt stand a chance, its still a race. The key point in this is that the male pleaded guilty......you only plead guilty if you are guilty, i for one would stick by my guns and fight all the way, an early guilty plea does get you a lighter sentence, but thats only usually used to get an admission out of someone, or when they know they are going to get sent down.

Im sure there were plenty of other factors involved, but as normal, a five year sentence will be at most 2 years, probably 1 1/2 with 6 months community service order or such like.

Even so, can you imagine going down for a couple of years? Heck, I can't.. someone like me probably wouldn't make it to the other end of the sentence :|

You would if your solicitor told you it'd be likely they'd find you guilty, so pleading guilty would give you a significantly lighter sentence.

Thing is, I wonder if the Fiesta WAS racing, and the 200SX really wasn't. Then the police ask the survivor of the Fiesta if they were racing - to which the answer was yes - even though only one party was racing, the other weren't bothered. A bit like the races claimed in the old VS section of MR2s beating Ferrari's - the Ferrari driver wasn't racing.

why have they locked the SXOC thread ?... is it a legal requirement ?

Don't want to be seen to be making an issue over minor details but a Fiesta zetec S is around 105bhp, as standard not the 75bhp claimed. Also I know that area, and have seen many 'racing' out of Festival Park onto the A500. Tragic outcome :cry:

he said there was a 75bhp difference the fiesta had around 115bhp.

the guy did plead guilty admitting to racing the sentence was expected, if he'd stuck with not guilty and still got the same sentence then that would have been unfair as from what i've read it sounds like he was just driving too fast and the fiesta driver was being an idiot and unfortunately things went wrong and i'm not surprised with the driving conditions. but we only have one side of the story
