Just to clarify the new rule which you'll find in practice, is a waste of time:

From 1/1/12, if the car had a cat when built, it should be present when MOT tested.

Whether it needs a cat test is irrelevant in respect of the new rule.

If it's not present, then fail.

HOWEVER

My MOT tester

(who has discussed the new rule with his regional VOSA rep), has adopted the following attitude to the new rule:

The new rule does not affect the requirement of a cat test for any particular vehicle.

So, if vehicle is not in MOT manual

(e.g.

pre 31/8/95 MR2 Turbo), then still no cat test required.

The reason no cat test required is because VOSA hold no emissions data on vehicle, hence no test required.

If VOSA hold no data on vehicle, how can they possibly expect him to know whether the car had a cat fitted from new?

He is not expected to research on the interweb whether the car had a cat from new.

He IS expected to enter reg.

and chassis number into DVLA computer system, and do as he is told.

If DVLA system says cat test not required, then as far as he is concerned no one knows if a cat was fitted.

And where there is doubt, benefit of doubt in favour of car owner is to be given.

So, bottom line, no change.

Point of interest:

My Noble is 2001 registered.

It should therefore be required to have a cat test.

However, Noble did not register the car in the correct manner when built, and as a result, my car does not appear in the online testers' database.

So NO cat test required.

I queried this with VOSA and they have clarified that i can legally run my car with no cats.
