All is not lost dude, is the other guy admiting libility? If yes then there's no issue, his insurance co cannot write off your car (unless so badly damaged it can't be repaired which yours obv can.) You have a right to be put back in the position you were before the accident. Insist that they have it repaired at bodyshop of your choosing. Accept nothing less. Do you have free legal cover with your policy? Phone them, be prepared to take them to court if necessary. Where is your car now? Hopefully at your house - if its not at your house get it back there ASAP and under no circumstances let it go anywhere other than to be repaired! There's a couple of people on the CRX UK forum that I use who've taken this course of action with great sucess. It might be worth joining and searching for posts by Mark, or PM me and i'll find them for you.

Ah mate pi**ed, glad your ok though cos a little bit more toward the rear and the car would have entered through your door :shock:

I hope you get it sorted, your car is unique.. I spotted it parked just off Regent Street a couple of months back, from a distance I knew it was yours!

Just to add to that, if you can get the guy to fully admit liability - can't imagine he wouldn't, you don't even need to tell your insurance company.

If I were you, I'd go direct to their insurance company, as it means you get things done a lot quicker, and won't have it against your insurance record as a non-fault accident. I did this and it worked absolutely fine [thumleft]

Wise words there mate, but the first thing I did when I got home was call my insurance company, so they're fully informed and are kick starting the whole process. From previous experience, a non-fault accident hasnt affected me whatsoever, so I dont really mind whether or not my company knows as long as a solution is found asap.


Start doing your homework now by searching the ads. Also make sure that the car is retained in the body shop as they will be charging the insurance company storage by the day. It helps to point out, particularly if you go through a broker, that the longer they take to settle the higher their loss on the accumulating storage charges. They can't remove it as it remains your property until the settlement is made.


Good idea there about the workshop and creating the mounting charges to add pressure. I'll definitely be using that one methinks, thanks.

So far have just informed my insurance company. They are arranging a hire car for me to use and will be starting the process by contacting 'his' insurance company to see he admits liability. He did NOT at the time of the accident, he didnt say anything. However his insurance company may see it for what it is, also there's a cctv that most likely caught the accident, also there's an independant witness, also there's the 84 photos I took straight away of the accident from every conceivable angle. My company agrees it a non-fault situation. I'm expecting a call from their nominated workshop today regarding the assessor's visit.

I'll keep you all posted.


Woke up this morning and almost forgot about how bad it looks till I opened the curtains. Oh boy, she looks terrible. Like some have said above though, she 'may' be repairable. At the end of the day most things are, its really a case of how much you're willing to spend on something worth £ xxxx. Hopefully , if the chassis is straight underneath it all then there might be a chance.

Ideally I would like it back on the road because I'm a sentimental fool who loves that car dearly. Possible outcomes are...

a) they assess, then repair the car.
b) they write it off, I buy it back and break it
c) I call it a day, take the money and walk away
d) they write it off, I buy it back and transfer the best bits over to a rolling shell


a: huge smile on my face
b & c: maybe its time to go for that FD?
d: I always said if 'I' ever wrote off that car , I wouldnt haev another MR2 as I'd just keep comparing it to that one which I really do love THAT much. I know, I'm insane!

This is horrible.

I wrote my 2 off 3 weeks ago. Coming back from wales at night on a B road l came to a section of road that was under water doing 60mph. Shot me off the road into a ditch, hedge, sign post and a tree. I was just happy to be ok and belive me l loved the car to bits. Even the traffic cop said it was in no way my fault.

Anyway my car was a 1995 UK Rev 3 n/a with 151K on the clock. I got offered £1900 for it off my insurance :D. That was with highway insurance through adrian flux.

I hear ya mate, but what reallt grates is the it wasnt my fault. There was no misread of the conditions no showing off, no running out of talent, nothing induced by me. No, some sunday driving elderly idiot decided for me that my car was coming off the road.

but if you are not at fault, dont they repair it ?
since they will claim the other company to repair ? what did you declare as ur insure value??

yes I bloody did hurt my head! Though only for first five minutes. To be honest though, getting a bout of the old post accident stiff-neck.....no joke. Off to the GP tomorrow just to be safe.

Yes, you're right, they 'should' pay. Could even use the op for a new look. Who knows. We'll have to see what happens. Like above, I see several possible outcomes.

One positive though, I didn't have my insurance details at the time. Couldn't remember any of it as just renewed with a new company after 4 yrs with the old one. Luckily he had ALL his details. Strange thing is, he hasn't called to get my details at all, hmmmmm, could this mean he's not trying to claim? Could be a good sign of a smooth process? Here's hoping.

Ok, I thought I made myself clear earlier in the thread with specific requests and I've also kept everyone up to date with my situation and where I'm at with insurance. I will continue to do so in the hope that it will maybe help others should something similar happen to them so....


PLEASE DO NOT START 'VULTURING' ME OVER MY CAR AND PARTS. IF YOU CAN READ ENGLISH, YOU WILL SEE THAT IT IS IN NO WAY AT THAT POINT. HAVE SOME CONSIDERATION FOR OTHERS, ESPECIALLY WHEN THEY CLEARLY STATE HOW ANGRY AND UPSET THEY ARE. ANYONE 'VULTURING' AT THIS POINT WILL BE BLACKLISTED FROM ANY SALE OF PARTS, OR THE CAR, THAT MAY OR MAY NOT OCCUR.

Fair point. People are just starting to get my back up Michael you know. 48 hours later and people start hassling you to tear your car apart after youve taken the time to explain your feelings about the incident/car and even listed your preference of what should happen next (ie. the car gets repaired). I've even kept people in the loop adn will continue to do so.

If some people are THAT desperate for used parts that they have to be THAT inconsiderate to fellow IMOCcers/petrolheads, maybe they should have bought a car they can actually afford to run.

im also really gutted for you mate, i had an old bloke hit me about 8 months ago i will say old because when i said old codger i got told off and my post was removed because they didnt find it appropriate as i actually done alright in the end because my scuffed bumper polished out and i was £150 in pocket but hey thats the moderators for you.
he didnt see me stop and ran into the back of me every panel on his car was damaged i later found out he had quite a few acidents, i dont want to tar everyone with the same brush but it seem there's far to many bad drivers and sadly most of them are above 65 and the worst thing is we look after our pride and joy only to get offered silly money for our car when written off,
i had a mint escort rs turbo that was written off by a drink driver i argued my case and knocked back 2 offers, i settled on £3,500 which was what i payed for the car i had loads of pics that i sent off and they understood why i was not going to settle on the silly offers. i also got £350 compo for slight whiplash.

all the best i hope it does go back on the road. :thumleft: :thumleft: :thumleft:
she's all comming together nicely now after a fair bit of cash spent, not bad for just an n/a now for some body kit i think.

Bobster, I'm absolutely gutted for you mate. Having written off my daily driver 6 weeks ago through a non fault accident (similar to yours, pulling out in front me as oncoming traffic) I know a small portion of how you feel.

Admittedly (and thankfully) it wasn't my MR2, but still, the frustration and anger is the same due to the fact that someone through pure stupidity has put all your well laid plans to rest, for some time at least. I was 2 weeks from clearing all my debt, something I'd been working hard at for the last 18 months. I had planned to run my car for a further 3 years before considering getting rid of it. It owed me nothing and was a brilliant runner, never let me down. Now I have to question what I'll get for it from the insurance company, declare the accident on insurance quotes for 5 years, maybe out of pocket due to having to buy another car, which may or may nor be in as good condition both mechanically and cosmetically. All the while he was able to drive off and is still driving his car around. I ask how is it fair that the victim is the one left worse off in situations like this?

With regards to a personal injury claim... DO IT! Every other ****er out there does it. Claim head aches for the next 2 weeks. Time off work etc. And keep recipts for everything!! Even Neurofen as its all able to be claimed back from the other side. This is currently where my claim is, I'm having the schedule of extra expenses drawn up by the legal representatives.

ALso I hope you enjoy your courtesy car as much as I'm enjoying mine :thumleft:

fair point bobby, i'd be pi$$ed if everyone was after my bits after my pride and joy had just been wrecked by some numpty..
