Test drive crash

Post by JohnnyC »

Someone was selling an MR2, and on the test drive the owner wrecked it!!

Gave the potential buyer a couple of cracked ribs.

Anyone here?

Will the test driver, who crashed the car, have adequate insurance to cover the loss?
In theory, you shouldnt let some one drive your car unless the other person can provide proof they are insured to do so. They'd need to have at least 3rd party on any other vehicle to even be legal.

The potential buyer didn't crash the car, the owner crashed the car.

Someone on the FTO forums was viewing an MR2.

Don't have any more details, yet.

I haven't bothered with the link as you need to be a paid member to view it.

As an update though, the car was apparently SORN'd so shouldn't have even been on the road

And the owner/seller has been in contact with the injured potential buyer saying that he can get another one for him

So if the potential buyer decides he would like compensation for his ordeal who will he get payment from :-k

Suppose it depends whether or not the potential buyer knew it was SORN'd :-k

My MR2 is insured but SORNd. (Soon back on the road though, been moth balled last few months!)
Although I doubt they'd pay out if it was used on the road - passenger might be eligible for compo if the car was indeed insured, although I suspect it wasn't.

That's the thing.
Most (if not all) insurance policies require that the vehicle is in a legally road-worthy condition and if it's not taxed then it ain't.

Similar thing happened to me last week.
A mate of mine was selling a motorbike which has been parked-up in my garage for 6 months.

Guy turns up to look at it. My mate phones to ask if I'll "deal with it". Guy looks over the bike and asks to take it for a test ride. I phone my mate and ask. He says "Okay, as long as you follow him".
About 5 minutes into the test ride the guy stops rather sharply, loses the front and bins the bike.
Turns out that the front brakes have seized up and the bike wasn't taxed, MOT'd or insured and now my mate's not speaking to me cos, apparently, it's "my fault".

On topic, I guess if I'd travelled a long way to see a car and the owner wrecked it I suppose I might consider suing for injury purely to cover the cost of my travel expenses seeing as, basically, the owner had wasted my time.
In the end I doubt I'd do it though.

He blames me cos I "didn't check it over before letting the guy ride it".

Thing is, he doesn't live around here BUT he was back in town for a few days and yet couldn't be ar$ed to come over and sell the bike for himself.

It probably would have scared him if he saw me behind him in the MR2 cos I was riding a Ducati when I set off :P
